Terms & Conditions

The following General Terms and Conditions (GTC) also contain legal information about your rights under the regulations on contracts in distance selling and electronic commerce.

1. Scope/Definitions
1.1 All services and deliveries of TL24 GmbH & Co. KG via this Internet store are subject to these General Terms and Conditions. Any deviating terms and conditions of the buyer are hereby expressly rejected. These shall not become part of the contract either by delivery of the goods or by any other implied act.

1.2 A consumer in the sense of these General Terms and Conditions is a natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur in the sense of these General Terms and Conditions is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his independent professional or commercial activity.

2. Contracting party
A contract of sale is concluded with TL24 GmbH & Co. KG, Kaiserstr. 9, 51545 Waldbröl, represented by the personally liable partner Jelano GmbH, which is represented by the managing director Julien Quadt.

3. Order procedure
You order in our store by
1. putting articles into the shopping cart
2. call up the shopping cart
3. go to the checkout
4. register as a registered customer, register as a new customer or order as a guest without registration
5. enter or check your shipping and billing address
6. select the shipping method and the payment method
7. take note of our terms and conditions and the revocation policy and confirm this
8. confirm the correctness of your information by clicking the button "Order for payment" at the end.

4. Offer and conclusion of contract
4.1 Your order constitutes a binding offer to us to conclude a purchase contract. With the order you declare bindingly that you wish to purchase the ordered goods.

4.2 You will receive a copy of the order data with the order receipt confirmation e-mail, which you can save. This confirmation of receipt expressly does not constitute an acceptance of your offer.

4.3 A purchase contract shall only be concluded when we accept your binding order by delivering the goods or by confirming the acceptance in text form by sending you a separate transport information/shipping notification by e-mail. An acceptance of your order shall take place within five working days at the latest.

4.4 In deviation from the above, in the case of an order with the payment method prepayment, a purchase contract is already concluded with the sending of the payment request by e-mail. The request for payment will be sent within five working days after your order at the latest.

4.5 The contract is concluded exclusively in German.

5. Correction of input errors/storage of the contract text
5.1 You can correct the contract declaration made by you in the context of the order at any time before sending it by clicking on the "Change" button. After sending the order, a correction is no longer possible.

5.2 Your orders will be stored by us until the complete processing of the purchase transaction. If you lose your records of your orders, please contact us by e-mail. We will gladly send you a copy of your order data as long as your order has not yet been processed. After complete delivery of the ordered goods, we will delete the order data subject to the statutory retention periods and can no longer make them available.

6. Prices and shipping costs
6.1 The prices stated on the product pages include the statutory value added tax plus shipping costs.

6.2 In addition to the stated prices, we charge shipping costs for delivery. The shipping costs are clearly communicated to you on the shipping costs overview, in the shopping cart system and on the order page.

7. Delivery
7.1 Delivery will be made exclusively to the countries indicated on the page "Shipping and payment conditions".

7.2 The delivery time depends on the respective information in the article description. The time limit for delivery begins to run on the day after the payment order is issued to the remitting bank and ends on the day on which the indicated delivery time in days has expired. If the last day of the period falls on a Saturday, Sunday or a general holiday recognized by the state at the place of delivery, the next working day shall take the place of such day. Within Germany, the delivery time is a maximum of 14 working days, abroad the delivery time is a maximum of 21 working days.

7.3 The delivery time to foreign countries is a maximum of 21 working days. The delivery period begins on the day after the payment order is issued to the transferring bank and ends on the following 21st working day. If the last day of the period falls on a Saturday, Sunday or a general holiday recognized by the state at the place of delivery, the next working day shall take the place of such a day.

8. Payment
8.1 Payment shall be made by prepayment, by Paypal, by credit card or by cash on delivery at the option of the Buyer.

8.2 In the case of payment in advance, you will receive the payment details with a separate notification. The payment must be received by us within 8 days of receipt of this notification. We deliver the goods subject to receipt of payment, taking into account the stated delivery times.

8.3 If the payment method PayPal is selected, the payment shall be processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg subject to the PayPal terms of use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.

Paypal is the online payment service that allows you to pay for your purchases easily and quickly. Please inform yourself about opening an account with PayPal on the Internet at: www.paypal.de. Once the payment is booked, we will deliver the goods taking into account the stated delivery times.

8.4 If you choose to pay by credit card, please follow the payment instructions after completing the order. Your credit card will be charged upon completion of the order. As soon as the payment is booked, we will deliver the goods taking into account the stated delivery times.

8.5 If you select the cash on delivery payment method, the total amount will be collected in cash by the delivery person. Please note that the deliverer will charge an additional delivery fee of 2.00 EUR, which we cannot influence. With the payment method cash on delivery, the shipment will be sent from the day of the order, taking into account the stated delivery times.

9. Reservation of proprietary rights
Until full payment, the goods remain our property.

10. Warranty
10.1 The limitation period for statutory claims for defects is two years, in the case of delivery to entrepreneurs within the meaning of Section 1.2 one year. The period shall commence in each case on the date of delivery, i.e. receipt of the item by the Buyer.
This shall not affect any claims for damages arising from injury to life, body or health which are based on an intentional or negligent breach of duty by the Seller or its legal representatives or vicarious agents as well as claims for other damages based on intentional or grossly negligent breach of duty by the Seller, its legal representatives or vicarious agents.

10.2 Otherwise, the statutory provisions on liability for defects shall apply to all goods offered by us.

11. Final provisions
11.1 The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the U.N. Convention on Contracts for the International Sale of Goods, insofar as the protection granted by mandatory provisions of the law of the country in which the customer, who is a consumer, has his habitual residence is not withdrawn.

11.2 In the case of contracts with merchants, i.e. customers who operate a commercial business or are classified as merchants in the German Commercial Code for other legal reasons, as well as with legal entities under public law, Siegburg/Bonn shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
